Legal cannabis businesses in the United States face significant financial challenges due to a federal tax law, section 280E, originally designed to target illegal drug traffickers. This law prevents these businesses from deducting standard business expenses, leading to high effective tax rates. Industry stakeholders, including the National Cannabis Industry Association and business owners like Mitch Woolhiser, express frustration over the lack of legislative change. Despite state-level legalization, federal laws continue to impose financial burdens, prompting calls for Congress to amend the tax code. The situation highlights the tension between state and federal regulations in the evolving cannabis industry.

Argentine President Javier Milei has introduced a comprehensive reform bill to Congress, aiming to overhaul the tax system, electoral law, and public debt management. Key proposals include privatizing public companies, introducing a 15% export tax, and raising export taxes on soy. The bill also seeks to amend the electoral system and grant temporary legislative powers to the presidency. Despite the ambitious agenda, Milei's coalition holds a minority in both legislative chambers, making the bill's passage uncertain. Revenue Procedure 2022-39 Continues Qualified Amended Return Treatment for Audit Disclosures, Adds Large Partnership
16 Nov 2022

|
English
| Tax Law
The IRS released Revenue Procedure 2022-39 on November 16, 2022, updating the procedure for large corporate taxpayers and large partnerships under continuous audit to obtain Qualified Amended Return (QAR) treatment for disclosed items at the beginning of an audit. This procedure replaces Revenue Procedure 94-69, extending the same core approach and expanding it to include large partnerships. The new procedure is effective for examinations beginning on or after November 16, 2022, and applies to taxpayers notified of an LCC or LPC audit who have been subject to examination for four of the prior five years. Disclosures must be made on Form 15307 within 30 days of eligibility notification, and only for errors and omissions unknown at the time of filing. Proper disclosures will be treated as shown on a QAR, providing penalty protection, while inadequate disclosures will not receive automatic penalty protection.

Altria filed a tax return in accordance with the new rules but sued for a refund, arguing that the change contradicts the plain language of the statute and Congressional intent. The case highlights the complexities of stock attribution under C.F.C. rules and the potential for legislative changes to have unintended consequences.

Thousands of French citizens, who are also U.S. dual nationals, face significant challenges due to the U.S. Foreign Account Tax Compliance Act (FATCA), which requires them to pay U.S. taxes despite minimal connections to the country. The law has led to banking difficulties and administrative burdens for these 'accidental Americans.' French lawmaker Laurent Saint-Martin calls for renegotiation of the FATCA agreement or a moratorium to protect dual nationals. Despite discussions with the U.S. State Department and IRS, the Trump administration has shown no willingness to amend the law.

The guidance aims to help these businesses understand their legal responsibilities, protect workers, and ensure compliance within their supply chains. It covers the importance of filing intermediaries returns, following PAYE regulations, abiding by VAT self-billing requirements, and conducting right to work checks. The guidance also emphasizes the need for employment businesses to conduct due diligence on umbrella companies to avoid tax avoidance and protect their reputation. UK Repeals DAC6 Reporting Triggers

The UK Government has repealed all but one of the reporting triggers under the UK regulations implementing EU Council Directive 2018/822 (DAC6) on cross-border tax arrangements. This decision, effective from 31 December 2020, retains only hallmark Category D, aligning with OECD's Model Mandatory Disclosure Rules. The repeal is seen as a move to follow international standards post-Brexit. UK-based intermediaries now have limited reporting obligations under DAC6, while EU-based intermediaries must still comply with the full scope of DAC6. The UK plans to replace DAC6 with the MDRs and will consult on new legislation.

The newly signed Republican tax bill, marking the most significant overhaul of the U.S. tax code in over three decades, is expected to significantly impact top college athletic departments by removing tax deductions for alumni contributions related to season tickets. This change threatens a major revenue stream for these departments, with Alabama's athletic director Greg Byrne expressing concern and urging donations before the law takes effect. The House Ways and Means Committee projects the adjustment will net the government $200 million annually, but it remains uncertain how alumni will respond to the loss of tax deductions, potentially leading to substantial revenue declines for institutions like Oklahoma, Louisville, and Kansas.

On December 1, 2023, the Department of the Treasury and the IRS released proposed regulations providing additional guidance on the clean vehicle tax credit's excluded entities provision, which disqualifies vehicles with batteries containing components from foreign entities of concern (FEOC) starting in 2024. The DOE also issued a proposed interpretive rule to clarify FEOC terms. The tax credit, part of the Inflation Reduction Act of 2022, aims to prevent countries like China, Russia, Iran, and North Korea from benefiting from the EV subsidy. The regulations define ownership and control criteria for FEOCs and propose a ledger system for tracking FEOC-compliant batteries. Comments on the proposed regulations are due by January 18, 2024.
