The law was a delayed response to a European directive on personal data protection and exempted the state from CNIL sanctions, liberalized the creation of files on the entire population, and ended the CNIL's 'conforming opinions' which were its main counter-power. The government could now ignore CNIL's advice, only needing to publish it in the Official Journal. This change enabled the centralization of fingerprints of nearly the entire population into a single file, despite CNIL's negative opinion and a previous constitutional censure, under the pretext of saving on civil servant positions. Critics like Louis Joinet and Raymond Forni saw this as a capitulation to post-9/11 security inflation, favoring large groups and increasing the number of security files under Nicolas Sarkozy's authority.
