Privacy-First Paradigm for Dynamic Consent Management Systems: Empowering Data Subjects through Decentralized Data Controllers and Privacy-Preserving Techniques
12 Dec 2023  |  www.mdpi.com  |  English  |  Data Privacy
This paper presents a model for dynamic consent management systems (DCMS) that emphasizes privacy-first approaches by utilizing blockchain technology to decentralize data controllers and incorporating privacy-preserving techniques. The model aims to empower data subjects by enhancing the security and privacy of their data in compliance with the General Data Protection Regulation (GDPR) in Europe. The proposed system uses permissioned blockchain platforms like Hyperledger Fabric to ensure data integrity and employs techniques such as secure multi-party computation, differential privacy, and homomorphic encryption to maintain data confidentiality. The paper also discusses the application of these technologies in the healthcare sector for managing patient data and sharing with researchers, providing guidelines for implementing security and privacy by design in DCMS.

Notice and Choice Cannot Stand Alone
19 Nov 2024  |  cacm.acm.org  |  English  |  Data Protection
The article critiques the 'Notice and Choice' approach to privacy regulation, highlighting its shortcomings due to complex and overwhelming privacy notices and lack of enforcement. It argues for the integration of notice and choice with strong privacy laws and automated tools like Global Privacy Control (GPC), which is gaining traction under laws like the California Consumer Privacy Act. The text discusses past initiatives like the Platform for Privacy Preferences Project (P3P) and Do Not Track (DNT), noting their failures due to lack of incentives and enforcement. It emphasizes the need for standardized technology frameworks and legal mandates to make automated privacy tools effective, suggesting that with proper support, notice and choice could still play a valuable role in privacy protection.

Spanish media launch lawsuit against Meta
04 Dec 2023  |  The Irish Times  |  English  |  Data Protection
Several dozen Spanish news media, represented by the Spanish Media Association (AMI), have filed a €550 million lawsuit against Meta, alleging unlawful advertising revenue generation through non-compliance with EU data protection regulations. The lawsuit claims Meta's practices give it an unfair advantage in the advertising market, jeopardizing the survival of Spanish media. The AMI's claim dates back to May 2018, when new EU data protection rules were introduced. Meta has faced multiple regulatory challenges, including a €1.2 billion fine by the Irish Data Protection Commission and a ruling by the European Court of Justice. The lawsuit covers Meta's practices until mid-2023, after which Meta introduced a new subscription service for EU users.

20 years ago, the CNIL bowed down to the State
26 Mar 2024  |  Next  |  French  |  Data Protection
The 2004 law profoundly altered the French National Commission on Informatics and Liberty (CNIL), particularly in its relationship with the government, from which it is supposed to be independent. The law was a delayed response to a European directive on personal data protection and exempted the state from CNIL sanctions, liberalized the creation of files on the entire population, and ended the CNIL's 'conforming opinions' which were its main counter-power. The government could now ignore CNIL's advice, only needing to publish it in the Official Journal. This change enabled the centralization of fingerprints of nearly the entire population into a single file, despite CNIL's negative opinion and a previous constitutional censure, under the pretext of saving on civil servant positions. Critics like Louis Joinet and Raymond Forni saw this as a capitulation to post-9/11 security inflation, favoring large groups and increasing the number of security files under Nicolas Sarkozy's authority.

Norway’s Privacy Battle With Meta Is Just Getting Started
30 Oct 2023  |  www.wired.com  |  English  |  Data Protection
Norway's privacy watchdog, Datatilsynet, led by Line Coll, is intensifying its scrutiny of Meta's new ad-free subscription model, arguing it still involves data tracking. Despite Meta's claims that user data won't be used for ads, Coll remains skeptical and is investigating further. The Norwegian regulator has already fined Meta $100,000 per day for illegal behavioral advertising, a decision upheld by a Norwegian court. The European Data Protection Board extended this ban across the EU, marking a significant win for privacy advocates. Coll's proactive stance aims to set clear guidelines for companies under European privacy law, focusing on Meta's practices and their broader implications for user privacy.
