26-year land battle: Gen Muhwezi, Mubiru feud escalates
05 Apr 2023

The Observer - Uganda
|
English
| Court Proceedings
The article details a 26-year land dispute in Kampala, Uganda, involving former minister Maj Gen Jim Muhwezi and James Mubiru, who claims rightful ownership of the land after his father's death. Mubiru's attempts to legally secure the land were met with resistance from individuals claiming to have bought the land, including Muhwezi. Despite threats and legal challenges, Mubiru obtained a certificate of ownership from the Buganda Land Board and a court judgment reinstating him as the rightful owner. However, Muhwezi's lawyer, Ahmed Kalule, argues that Mubiru's court orders were illegal and that Muhwezi is seeking to correct the situation through the High court. The dispute has involved arrests, allegations of torture, and a contested eviction enforced by court bailiffs.

Bail Efforts for Former JATU PLC CEO Hit a Snag Amidst Fraud Charges

Former Chief executive director of JATU PLC, Peter Gasaya, is facing difficulties in meeting bail conditions for his fraud charges involving over 5bn/-. His lawyers, Kung’e Wabeya and Nafikile Mwamboma, are requesting the court to set more affordable bail conditions, arguing that the current amount set deprives their client of his right to bail. State Attorney Caroline Matemu has asked for more time to respond to the defense's arguments. The bail conditions require Gasaya to submit 2.6bn/- or equivalent property deed and two Dar es Salaam-based guarantors with substantial assets. The case is adjourned until January 25. In a separate case, the Kisutu Resident Magistrate’s Court found three individuals guilty of murdering businessman Amadius Kilawila in 2010, with the defense set to present their case on January 17.

Swedish journalist Kim Wall disappeared after a trip with Danish inventor Peter Madsen on his submarine. Danish police found her body parts two months later. Videos of women being violently killed were discovered on a computer in Madsen's laboratory, which he claimed was used by many people. New evidence indicated Wall was stabbed post-mortem, and DNA tests matched Wall's DNA with samples from Madsen. Despite the mounting evidence, Madsen denies the charges of murder and mutilation. He claims Wall's death was accidental, caused by a hatch cover on the submarine. The court has extended his detention by four months as the investigation continues.

Christian B is currently on trial for unrelated sex offences in Portugal. Codin's testimony includes claims of Christian B's involvement in other criminal activities, including using a van for sexual encounters with young girls. The court proceedings also featured video footage related to the McCann case, which the defense argued could influence witness perceptions. The presiding judge has indicated insufficient suspicion of guilt for all charges, raising the possibility of acquittal.

Zimbabwean farmer and Mt Pleasant Legislator Allan Markham, along with two other applicants, has taken a land dispute to the High Court against several respondents including Augur Investments, businessman Kenneth Sharpe, and others. The dispute concerns a piece of land in Pomona Township that was transferred to Doorex Properties by the President of Zimbabwe. The respondents, represented by Scanlen and Holderness law firm, have argued that the applicants lack legal standing and have failed to obtain the necessary leave to sue the President. They contend that the proceedings are invalid and should be dismissed, citing a failure to comply with High Court Rules and a lack of direct interest in the land by the applicants.
